Legal Requirements

You must be 21 years of age or older, to order or receive alcoholic beverages from Pithy Little Wine Co. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from Pithy Little Wine Co. are not for resale, and are for personal consumption only.

eGift cards

1. Redemption
Gift Cards must be redeemed on www.pithywine.com toward the purchase of eligible products. Purchases are deducted from the Gift Card balance. Any unused balance will be placed in the recipient's Gift Card account when redeemed. If an order exceeds the amount of the Gift Card, the balance must be paid with a credit card or other available payment method.

2. Limitations

• eGift Cards may not be redeemed for the purchase of products at the Pithy Little Wine Co. Tasting Room Retail Store.
• eGift Cards cannot be used to purchase other gift cards
• eGift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. Unused eGift Card balances in an Pithy Little Wine Co. account may not be transferred.
• Wine Club discounts do not apply to the purchase of eGift Cards.

3. Risk of Loss
The risk of loss and title for eGift Cards pass to the purchaser upon our electronic transmission to the purchaser, recipient or delivery to the carrier, whichever is applicable. We are not responsible if a eGift Card is lost, stolen, destroyed or used without your permission.

4. Fraud
Pithy Little Wine Co. will have the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained eGift Card is redeemed and/or used to make purchases on pithywine.com.

5. Limitation of Liability
PITHY LITTLE WINE COMPANY., INC ("PITHY LITTLE WINE CO.") MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EGIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT AN EGIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH EGIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

6. Disputes
Any dispute relating in any way to Pithy Little WIne Co. Gift Cards in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $1,000 shall be adjudicated in any state or federal court in Los Angeles, California, and you consent to exclusive jurisdiction and venue in such courts.

7. General Terms
eGift Cards are issued by Pithy Little Wine Company, Inc. a California corporation. When you purchase, receive or redeem an Pithy Little Wine Co. eGift Card, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these eGift Card terms and conditions. Pithy Little WIne Co. reserves the right to change these terms and conditions from time to time in its discretion. All terms and conditions are applicable to the extent permitted by law.

States Authorized for Direct Shipment

Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to your state. Please contact us with inquiries or visit the Shipping section of our website.

Shipping Costs

Golden State Overnight & FedEx Ground are the Pithy Little Wine Co. carriers of choice (common carrier). Ground shipping is provided by GSO & FedEx at a flat rate to the contiguious 48 states. Under 3lbs $6.00 over $3lbs $10.00. Additional shipping fees may apply to Hawaii & Alaska. FedEx overnight or second day, and express saver services are also available. *Note – If the customer selects FedEx as his or her carrier, the customer pays all shipping charges, regardless of his or her Wine Club membership or purchase amount.

Wine is a Delicate Commodity

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. Pithy Little Wine Co. is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
